Acceptance of These Terms

Using FotoMagic's Services in any way means you have read and agreed to these Terms of Service. If you disagree with any part of these Terms, please stop using the Services right away.

Account Creation

Certain features require you to register an account. You are solely responsible for keeping your login credentials secure and for everything that happens under your account. You agree to provide truthful, up-to-date information at registration and to keep it current.

Your Content

You own everything you create through the Services—videos, text, data, and any other material, whether shared publicly or kept private (your "User Content"). Images and videos produced through our Services live only on your device; nothing is uploaded to or stored on our servers. You are responsible for making sure your use of the Services and your User Content complies with all applicable laws.

Your User Content must never:

• A. infringe on any third-party rights, including copyright, trademark, trade secrets, or privacy;
• B. break any law or regulation;
• C. be harassing, defamatory, threatening, discriminatory, obscene, sexually explicit, or promote violence, extremism, or other illegal conduct, or cause harm or embarrassment to any individual;
• D. encourage or facilitate any illegal act that puts others at risk;
• E. reveal anyone's identity without proper authorization, or for anyone under 18, without parental or guardian consent;
• F. expose private contact information or otherwise invade someone's privacy;
• G. include viruses, malware, or any other harmful code.

Prohibited Conduct

You also agree not to engage in—or allow others to engage in—any of the following while using our Services:

• A. using the Services or their content in ways not permitted by these Terms or beyond the platform's intended purpose;
• B. using the Services for unlawful purposes or in any way that conflicts with these Terms;
• C. interfering with, disabling, overloading, or degrading our systems, security measures, or other users' experience;
• D. using automated tools—bots, scrapers, crawlers, or similar—to extract, copy, index, or bypass the normal operation of our Services;
• E. copying, modifying, reverse-engineering, or otherwise tampering with any part of our Services;
• F. merging or integrating our Services with third-party software without authorization;
• G. introducing malicious code, viruses, or destructive elements into our Services;
• H. infringing our intellectual property rights in any form.

Intellectual Property

FotoMagic takes intellectual property seriously and expects the same from its users. We will promptly investigate copyright infringement claims and take appropriate action under the Digital Millennium Copyright Act ("DMCA") and other relevant laws.

Third-Party Links and Services

Our platform may link to or integrate with external services (such as Facebook, Instagram, or other social networks) that are operated independently. We have no control over those sites or services and are not responsible for their content or practices. Links do not constitute endorsements. Your use of any third-party service is subject to that service's own terms. We do not store sensitive personal data—such as credentials, user IDs, or passwords—on any linked third-party platform.

Advertising

Advertisements may appear within the Services from time to time.

Indemnification

You agree to defend, indemnify, and hold FotoMagic and its officers, directors, employees, agents, and affiliates harmless from any claims, liabilities, damages, losses, and expenses—including reasonable legal and accounting fees—arising from (a) your use of the Services, (b) your User Content, or (c) your breach of these Terms.

Disclaimer of Warranties and Limitation of Liability

Unless explicitly stated in these Terms, FotoMagic, its affiliates, subsidiaries, and licensors make no warranties of any kind—express or implied—including implied warranties of merchantability or fitness for a particular purpose. All such warranties are expressly disclaimed. To the fullest extent permitted by law, any implied warranties are limited to the scope defined in these Terms.

Entire Agreement

These Terms represent the complete agreement between you and FotoMagic on the subject matter herein, replacing all prior written or verbal discussions, proposals, and agreements, including any purchase order terms.

FotoMagic may transfer these Terms, or any rights and obligations under them, to a third party without prior notice to you. Failure to enforce any provision of these Terms is not a waiver of that right. If any provision is found invalid or unenforceable, the remaining provisions continue in full force.

Governing Law and Disputes

If a dispute arises with FotoMagic, you agree to first try to resolve it informally with us. Any dispute arising from or related to this Agreement will be resolved in accordance with App Store guidelines.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods does not apply. You submit to the exclusive jurisdiction of courts in California for any disputes relating to these Terms or the Services.
